1. Acceptance of Terms

By accessing or using TTNiche ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TTNiche is a data analytics platform that provides insights into TikTok content niches, trends, and creator performance. The Service includes niche browsing, AI-powered video analysis, video downloading, transcription tools, and creator analytics.

3. Beta Status

TTNiche is currently in beta. While we strive to provide accurate and reliable data, the Service is provided on an "as is" and "as available" basis. Features may change, be added, or removed without prior notice during the beta period. We make no guarantees regarding uptime, data accuracy, or feature availability.

4. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account.
• One account per person. Multiple accounts may be suspended.
• We reserve the right to suspend or terminate accounts that violate these terms.

5. Free and Pro Plans

Free Plan: Limited daily usage (30 minutes), 3 favorites, no access to AI Analyzer or Creator Spy.

Pro Plan ($11.99/month): Unlimited access to all features, including AI Niche Analyzer, Creator Spy, and unlimited favorites.

6. Payments and Billing

• Pro subscriptions are billed monthly via PayPal at $11.99 USD.
• Payment is charged at the beginning of each billing cycle.
• You can cancel your subscription at any time through PayPal. Cancellation takes effect at the end of the current billing period.

7. Refund Policy

Due to the digital nature of the Service and its current beta status, all sales are final. No refunds will be issued. By subscribing, you acknowledge that:

• The Service is in beta and may contain bugs or incomplete features.
• Data accuracy is not guaranteed.
• Features may change without notice.
• You are paying for access to the Service as it exists at the time of purchase.

If you experience a technical issue that prevents you from using the Service entirely, contact us at admin@ttniche.com and we will work to resolve it.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to access other users' accounts
• Scrape, copy, or redistribute data from the Service
• Use automated tools to access the Service (bots, scrapers)
• Share your Pro account credentials with others
• Resell access to the Service

9. Intellectual Property

The Service, including its design, code, and analytics methodologies, is owned by TTNiche. TikTok content displayed within the Service belongs to its respective creators. "TikTok" is a registered trademark of ByteDance Ltd. TTNiche is not affiliated with TikTok or ByteDance.

10. Data and Accuracy

TTNiche provides analytics based on publicly available TikTok data. We do not guarantee the accuracy, completeness, or timeliness of any data. Niche scores, engagement rates, monetization estimates, and AI-generated analyses are approximations and should not be relied upon as the sole basis for business decisions.

11. Limitation of Liability

To the maximum extent permitted by law, TTNiche shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 3 months.

12. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email.

13. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• Any data, analytics, trend scores, or earnings estimates will be accurate or reliable.
• The results obtained from the use of the Service will meet your expectations.
• Any errors in the Service will be corrected.

15. Indemnification

You agree to indemnify, defend, and hold harmless TTNiche, its operators, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any content you submit through the Service.

16. No Guaranteed Earnings

TTNiche provides analytical data and estimates for informational purposes only. We make no guarantees about potential earnings, income, or revenue from any TikTok niche, content strategy, or the Creativity Rewards Program. Estimated earnings displayed on the platform are rough approximations based on publicly available data and should not be construed as income promises or financial advice. Individual results vary significantly.

17. Third-Party Links and Services

The Service may contain links to third-party websites or services (including TikTok, PayPal, Google, and Discord). We are not responsible for the content, privacy practices, or availability of these external services. Your use of third-party services is governed by their respective terms.

18. Force Majeure

TTNiche shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, internet outages, server failures, third-party API changes or discontinuation, government actions, or pandemics.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TTNiche regarding the use of the Service.
